Terms of Service

Welcome to modernD3vforall ("the Service," "the Platform," "we," "us," or "our"). modernD3vforall is operated as a sole proprietorship under a registered DBA. By accessing or using the Service at modernd3vforall.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Definitions

  • "Service" refers to the modernD3vforall web application, including all features, content, exercises, and tools available at modernd3vforall.com.
  • "User," "you," or "your" refers to any individual who accesses or uses the Service.
  • "Account" refers to the registered profile a User creates to access the Service.
  • "User Content" refers to any code, text, or other material that a User submits, uploads, or inputs through the Service.
  • "AI Features" refers to functionality powered by third-party artificial intelligence services, including but not limited to code explanations and feedback.
  • "Free Chapters" refers to the chapters available at no cost and without payment details.
  • "Membership" refers to paid access to the Service. Membership types and their terms are described in Section 5.

2. Eligibility and Age Requirement

The Service is intended for users aged 13 and older. By creating an Account, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and consents to these Terms on your behalf.

We do not knowingly collect personal information from children under the age of 13. If we learn that we have collected information from a user under 13, we will promptly delete that information and terminate the associated Account. If you believe a child under 13 has provided us with personal information, please contact us at hello@modernd3vforall.com.

3. Account Registration

To use the Service, you must create an Account. Accounts are created by signing in with GitHub. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials secure and confidential.
  • Notify us promptly if you suspect unauthorized access to your Account.
  • Accept responsibility for all activity that occurs under your Account.

We reserve the right to suspend or terminate any Account that violates these Terms or that we reasonably believe has been compromised.

4. Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal educational purposes.

You do not acquire any ownership interest in the Service or its underlying software, content, or infrastructure. This license does not include the right to:

  • Copy, republish, or distribute the exercises, teaching material, or curriculum.
  • Create derivative works based on the exercises or curriculum.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell, sublicense, or provide third-party access to the Service or to your Account.
  • Use the Service or its content to build or train a competing product or service.
  • Use automated tools (bots, scrapers, crawlers) to access the Service.

4.1 Your solutions are yours

The code you write while using the Service belongs to you. You may keep it, publish it, put it in a public repository, include it in a portfolio, and show it to an employer. Nothing in these Terms restricts what you do with the code you wrote.

What you may not republish is our material: the exercise prompts, the teaching text, the hints, the misconception explanations, the reference solutions, and the curriculum structure. Posting your own solution to an exercise is fine. Posting the exercise is not.

5. Free Chapters and Payment Terms

5.1 Free Chapters

The first chapters of the Service are available at no charge and without payment details. We reserve the right to change which chapters are free at any time, except that we will not remove access to content you have already paid for.

5.2 Membership

Membership is currently sold as a one-time purchase. Founding memberships bought during the alpha or beta periods are charged once, with no recurring charge, no billing interval, and nothing to cancel. They include all current and future modules at no additional cost, for as long as the Service operates.

We may offer other membership types in future, including recurring ones. If we do, the terms of that membership, including any recurring charge, will be presented to you before you buy it. Purchasing a membership never changes the terms of a membership someone has already bought.

Payment is processed by Stripe; we do not receive or store your card details.

5.3 Refunds

If the Service is not for you, email us at hello@modernd3vforall.com and we will refund your payment. We do not require a reason.

Refunding a payment ends the Membership and returns the Account to free access.

5.4 Price changes

Prices may change for new purchasers at any time. A price change never affects a Membership already purchased. If you have paid, you have paid.

6. User Content

6.1 Ownership

You retain all ownership rights to User Content you submit through the Service. We do not claim ownership of your code or other submissions.

6.2 License to Us

By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, store, and transmit your User Content solely for the purpose of operating and improving the Service. This includes sending your code to third-party services for the purpose of generating AI-powered explanations and feedback (see Section 7).

6.3 Responsibility

You are solely responsible for your User Content. You represent that your User Content does not violate any applicable law or infringe on the rights of any third party.

7. AI-Powered Features and Third-Party Services

The Service uses a third-party artificial intelligence provider to generate code explanations when you ask for one. Specifically:

  • This happens only when you request it. Ordinary feedback on a wrong answer is written by hand in advance and never leaves the Service.
  • When you do request an AI-generated explanation, the exercise, the failing case, and the code you submitted are transmitted to a third-party AI provider (currently Groq) for processing.
  • We do not send your name, your email address, or your account identity.
  • AI-generated explanations are provided for educational purposes only and are not guaranteed to be accurate, complete, or error-free. You should independently verify any AI-generated output.
  • Third-party AI providers are subject to their own terms of service and privacy policies.

By using AI Features, you acknowledge and consent to this data processing.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes what we collect, why, and what we do not do with it. By using the Service, you consent to the practices described there.

9. Intellectual Property

9.1 Our material

The Service, including its design, software, exercises, teaching material, branding, and logos, is owned by modernD3vforall or used under license, and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

Some source material is adapted from openly licensed curriculum and is attributed accordingly. Attribution and license terms for that material are published in the repository's NOTICE and LICENSING files.

9.2 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Submit content that is offensive, harmful, threatening, or harassing.
  • Attempt to gain unauthorized access to the Service, other user accounts, or related systems.
  • Interfere with or disrupt the Service or its infrastructure.
  • Share your Account credentials with others or allow multiple individuals to use a single Account.
  • Use the Service to distribute malware, spam, or malicious code.
  • Misrepresent your identity or affiliation.

We reserve the right to remove content and suspend or terminate Accounts that violate this section.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • Any defects will be corrected.
  • AI-generated content will be accurate or reliable.
  • The Service will meet your specific learning objectives, or lead to any particular employment outcome.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MODERND3VFORALL, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF SERVICE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless modernD3vforall and its owners, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your User Content.
  • Your violation of any applicable law or third-party rights.

14. Termination

14.1 By you

You may stop using the Service at any time. To delete your Account, email us at hello@modernd3vforall.com.

Because Membership is a one-time purchase rather than a subscription, there is nothing to cancel. If you want your money back, see Section 5.3.

14.2 By us

We may suspend or terminate your Account for a violation of these Terms. If we terminate a paid Account for a reason other than a violation of these Terms, we will refund the purchase.

14.3 Effect of termination

Upon termination:

  • Your right to access the Service ceases.
  • We may retain or delete your User Content in accordance with our Privacy Policy.
  • If you would like a copy of the code you submitted, email us at hello@modernd3vforall.com and we will send it to you.
  • Any provisions of these Terms that by their nature should survive termination (including Sections 4.1, 6, 9, 11, 12, and 13) will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation by contacting us at hello@modernd3vforall.com. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in Brooklyn, New York, administered under the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

16. Modifications to These Terms

We may update these Terms. When we do:

  • We will update the "Last Updated" date at the top of this document.
  • For material changes, we will notify account holders by email before the changes take effect.
  • Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

17. Modifications to the Service

We may modify, suspend, or discontinue parts of the Service. The Service is being built in the open and is not finished; features will change.

If we discontinue the Service entirely, we will give account holders notice by email.

18. Miscellaneous

  • Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and modernD3vforall regarding your use of the Service.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
